Do I have a Party Wall?

If you live in a semi-detached or terrace house you will share a wall (or walls) with your neighbour – that wall is known as a party wall.

Party walls usually separate buildings belonging to different owners but could include garden walls built astride a boundary – known as party fence walls.

Where a wall separates two different size buildings often only the part that is used by both properties is a party wall, the rest belonging to the person or persons on whose land it stands. (RICS Party Walls- Online)

How does the party wall act affect me?

A party wall act affects any persons who is the building owner or adjoining owner of a property that proposes to complete construction works which are directly to a party wall or what are close to and will affect the condition or structural properties to a party wall.

Who is responsible for setting up a party wall award?

A party wall award should be set up by the building owner prior to construction works, but unfortunately it is common that the adjoining owner will have to begin the process.

The award process is started with the issuing of a notices, this can be served by either parties personally or their appointed representative. Further guidance on these can be found on the RICS Webpage

Issue notices:

A condition survey will be conducted to ensure all current defects which are unrelated to the proposed works are recorded to protect the interests of both parties so no disputes can arise over wrongful compensation claims.

Party Wall Award:
An award will be complete detailing all relevant works and documentation.

Final Inspections:
Your survey will return to complete final inspections after the works are complete to ensure that no issues have arisen. If damages or a dispute has arisen they will offer they professional knowledge to determine a solution.
